The terms of use subject to the applications, websites, contents, products and services provided by   " CargoMate Application", which is owned by Afaq Applications for Logistics Services Est., commercial registeration no 4030537950, Dated 20/06/1438, established in the Kingdom of Saudi Arabia, and based in Jeddah.

CargoMate
The services provided by CargoMate Application connect the cargo carrier by road with and/or the consignor, who is a subscriber of the application, or whoever provides cargo services via CargoMate's website, via the website or applications of "CargoMate ". CargoMate services regulates the contractual relationship between the parties of road cargo transportation process, and provides price offers and types of some cargo trucks.

Approval of The Application user Agreement
If you want to subscribe to CargoMate application website, first you have to fill the registration form, then you must agree to the user agreement terms and conditions. If you fill and submit the form, or use any of the services provided in the website, you hereby agree to abide by the CargoMate user agreement. Your access and use of such services are considered an agreement on these terms, which establishes a contractual relationship between you and the application.

1) You are responsible for making all the required arrangements required to access the website. In addition, you are responsible for ensuring that whoever accesses the website through your internet connection is informed and complied with the terms of the website. When you view, browse, use, access the website or provide any content or materials through it, then you agree to these terms of use as a binding legal agreement between you and the “CargoMate” application without limitations or conditions. The term "you" refers to any person or entity that views, uses, accesses or browses the Website. If you don't agree to these terms of use, then you shall not use this website. 2) CargoMate website does not sell or interfere in any way with the goods, their type, manufacture, production, shipment or transportation.  The website is only an online market, where users can search and reach cargo carriers, and\or cargo forwarders, and\or truck lessors, and\or consignors, and\or consignees in their local area searched in the website. It connects the service applicant with the service provider who delivers the goods to the consignee. Furthermore, the parties of this relationship (the cargo carrier, cargo   forwarder,   consignor,   consignee,   and   truck   lessors)   (the   users)   are   solely responsible for complying with regulations and provisions of the public transportation authorities in relation to goods, cargo forwarders, road truck rent. These terms and conditions apply to CargoMate website and applications on iPhone, iPad, android and phone browser with internet connection.

Services Description:
CargoMate application allows its "user", who agrees to the user agreement, to contact the other users: cargo carriers, and\or cargo forwarders, and\or truck lessors, and\or consignors,   and\or   consignees  through   the   website.   When   the   parties   reach   an agreement, the service agreement form signed by the two parties is printed and uploaded to the website. The application provides you with an easy way to deliver you orders to "the users" who can benefit from the services available on the website.

This website aims to provide simple and easy service to its users; as it connects them and regulates the contractual relationship between the transportation process parties; by connecting\bringing the user together with other users who can provide cargo services within his local area. In addition, it enables users to choose between different price offers\truck data\types of cargo service, track the shipment until delivery and know the time of delivery.

However, it is very important for the user to understand that the application does not independently confirm in any way that he complies with regulations and laws of the public transportation authorities in relation to goods, as this responsibility is solely on the users. he must view the information provided by the other user on the website, or that is requested from him by another user, as well as the user's compliance with the applicable regulations and laws.

The application does not guarantee in any way the quality, type or components of goods,   nor   does   it   ensure   that   the   goods   comply   with   the   applicable   laws   and regulations. It also does not guarantee that the quality, type or components of goods is in accordance with the related specifications.

Furthermore, CargoMate Application will not be obligated or responsible for any delay in the receipt or delivery of the goods by another user within the period specified on the website, nor will it be required to pay any compensations, or held responsible for losses due to such delay in any way possible.

Price Offers
Users are solely responsible for ensuring that the following is correct:

1. The data and details of goods intended for transportation.

2. Type and quality of goods

3. Delivery addresses. The application shall have no obligation or responsibility in relation to wrong delivery addresses. The user who provided the address to the website shall be responsible for the track and delivery within the shipment process.

Order Cancellation
You have the right to cancel your order within (.......) minutes from its submission on our website. Although all the efforts are done to maintain the correct prices and specifications of the services, we reserve the right to cancel any order with incorrect information.   After   the   order   may   be   cancelled   by   the   user   after   he   receives   the confirmation message, and the application reserves the right to cancel any order after or before its confirmation, and notify the user immediately of such cancellation.
 
Registration in CargoMate
Any subscriber of the application obtains a "user name" and a "password", which he determines. The user's name is personal and belongs only to the user. Each user is given a unique user name, and only the user shall know his password. It is also the user's responsibility to choose and protect his password, and the application shall not be responsible for any problem arises from misuse of it. CargoMate application will notify the user via e-mail with offers, of which he can benefit, that is available within his local area.

When you use the website, you guarantee that any personal information you provide is valid,   accurate,   effective,   and   full   from   all   aspects,   and   that   you   will notify   us immediately   with   any   changes   to   your   personal   information   by   updating   your information on the website or by contacting us. You also agree to not to impersonate any other person or entity, or use a fake name or a name that you are not entitled to use.

You shall not register with different accounts to be used by the same person. The violation of such provision may terminate your account.

You also may not transport any material that is prohibited by the laws, religions, beliefs, sects or morals, and results in civil liability, or otherwise violate any laws, regulations, systems, or practices. Finally, you may not interrupt anyone's use or entertainment of the website.

Subscriber's responsibility
By using CargoMate application, the user agrees and acknowledges that:

The data provided in the registration form is correct, provided that it is required. The user will solely be responsible for any losses that may arise from any wrong or insufficient information given by him (e.g.; forgetting his account password). In such cases, his account shall be terminated.

The user is solely responsible for all the ideas, opinions, personal data provided by him in relation to the application services. He is also responsible for all files uploaded to the application and the personal information sent by him. CargoMate application will not be responsible in any way of such files, or any access to its services through a way that it did not authorize or specify. The user may not change the software of the application. He shall compensate the application for all the material and moral losses in case of violation of the mentioned provisions. The application will not be responsible for any losses that may arise from disclosure of its users' data by any unauthorized person. The user shall not send any messages that are threatening, immoral, racist, or in violation of the laws of the Kingdom of Saudi Arabia or any other country and the international agreements. Any correspondences, addresses, or nicknames should not be in violation of the laws, regulations, public morals and rules of good behavior. The user is obligated to not harass and\or threaten other users or any other customer services employees of CargoMate , and not to behave in a way that may impact the use of services by other users. Also, he shall not send or disclose any immoral, inappropriate, illegal materials or information that may cause damage using the name of any person or organization. All the data obtained through the use of CargoMate services is approved by the user, who will be responsible for any losses, information loss, or any other damage that may arise from the use of his computer. He is not entitled to claim compensation for any losses that may arise from his use of services. In addition, he is shall not use such services for any commercial or advertising purposes without prior consent of the application.

a) The application may monitor all the orders any time or continuously;

b) The application may use its system for commercial purposes.

c)   The   user   shall   not   send   via   e-mail   any   illegal   information,   or   distribute   any unauthorized messages; such as chain e-mails, malware, etc. In addition, he shall not keep or misuse any information of others. He is also held responsible for all the actions done by his name "user name". The user shall not access websites or services using a third party's account\registration without the consent of its owner. He also shall not use the websites for illegal purposes, nor shall he commit any abusive acts in the website or to its contents. The user will not use the website for any commercial activities unless otherwise authorized by the application. He shall not copy any of its content for the purpose of republishing it in print or via internet. Finally, he shall not record any entry for commercial purpose or any other purpose that is inconsistent with the website purposes.  

 
Visitor material and behavior
Other than personal information, which is included in the privacy policy of CargoMate application, any material that you transmit or post on this website will be considered non-confidential and non-personal.  CargoMate application will not bear any obligations with respect to these materials.   You are also prohibited from posting, uploading or sending to or from the website any material that violates any applicable local, national or international law; Illegal or fraudulent, amounting to unauthorized advertising.

Any comments or observations made by the User on the Site must not:
Contain any defamatory material, or a violation of public morals and the information crime   system,   or   a  violation.   /   Promote   violence   or   discrimination   /   infringe   the intellectual property rights of another person.

Violate any legal duty to a third party (such as a duty of confidentiality)/ Promotes irregular activity or invades another's privacy/ Gives the impression that it is issued by us or is used to impersonate another person or provide false information about your association with another person. The prohibited conduct in the above paragraphs is not exclusive.  He will compensate CargoMate for all expenses and damages incurred by you as a result of your violation of any of these restrictions.

You may not access or use the site for any purpose other than that provided by the CargoMate application.  The site is for the personal use of users only and may not be used   in   connection   with   any   commercial   interests   except   those   that   have   been specifically approved or approved by the “CargoMate” application.  In the event that the User commits any prohibited activities, the Company has the right to suspend, prevent or terminate the User's membership and prevent his access to the Service. CargoMate application may make any changes to the implementation of this agreement and amend existing articles or add new articles for the purpose of complying with any technical obligations and legislation to be issued in the future.

CargoMate application may change services that do not require membership to a form that requires membership.   CargoMate application may provide additional services, change some services partially or completely, or convert them to a paid service.

Termination of the agreement

1. CargoMate application may unilaterally terminate this Agreement at any time.

2. When laws or decisions are issued against the non-personal and non-commercial application.

Goods delivery
During any delivery of the goods carried out by a member and in the event that the customer is not present at the address specified on the site by the member, the goods ordered by the customer will not be delivered to any other place. In this case, the member shall accept all statutory responsibilities arising from ordering the goods to an incorrect address.

Governing Law and Jurisdiction
The terms of this website shall be governed by and construed in accordance with the rules.  Disputes arising in connection with these Site Terms (including non-contractual disputes) will be subject to the exclusive jurisdiction of the courts in the Kingdom of Saudi Arabia.

Severability of Terms and Conditions
In the event that any part of these Terms of Use is deemed illegal, void or unenforceable for any reason, then this provision will be deemed severable from these Terms of Use and will not affect the validity and enforceability of any of the remaining provisions of these Terms of Use.  No waiver by us shall be construed as a waiver of any prior or subsequent breach of any provision.

The content of the CargoMate application includes, without limitation, all core software content, databases, functions, software, website designs, audio, video, text, photographs and graphics.  The content of the CargoMate application on the website is provided to you “as is” for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited for any other purposes whatsoever without the prior written permission of the respective owners. It is prohibited to systematically restore data or any other content from the site or to create or author, whether directly or indirectly, a collection, author, database or directory without the written permission of the “CargoMate” application.

Limitation of Liability
To the extent permitted by law, CargoMate provides this content and website on an “as is” and “as available” basis and we make no representation or warranty of any kind, express or implied, regarding the content or availability of this website, or that it will be timely or error-free, that defects will be corrected, or that the site or server that makes it available are free of viruses or other harmful components. Subject to the previous paragraph, the CargoMate or the directors, officers, agents, employees or contractors of the CargoMate bears no responsibility for any direct, indirect,   special   or   consequential   losses   or   damages   (including   without limitation damages for loss of business or loss of profits), arising from contract, default or otherwise from the use or inability to use this website. Nothing in these Terms will exclude or limit liability for death or personal injury resulting from our negligence or the liability of our agents or employees.

Compensation
You agree to indemnify and hold CargoMate, its parent company, affiliates, associates, agents, officers, directors or employees harmless from any claim, demand, damage (whether direct, indirect or consequential) including attorney's fees made by any person in connection with your use the Site with any alleged infringement of the intellectual property rights or any other rights of any person or other entity associated with the Site, your breach of these Terms of Use and any other actions or omissions relating to the Site.
